B.C. Reg. 87/2024, deposited April 22, 2024, under the EMPLOYMENT STANDARDS ACT [section 127 (2)] and EMPLOYMENT STANDARDS AMENDMENT ACT, 2024 [section 5]. Order in Council 203/2024, approved and ordered April 22, 2024.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders the following:
(a) sections 1 to 4 of the Employment Standards Amendment Act, 2024, S.B.C. 2024, c. 2, are brought into force;
(b) the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in the attached Schedule.

Schedule
1 Section 5.1 (1) of the Employment Standards Regulation, B.C. Reg. 396/95, is amended
(a) by adding the following paragraph:
(a.1) section 16 (1) [employers required to pay minimum wage] of the Act; , and
(b) by repealing paragraph (e) and substituting the following:
(e) section 18 (1) [minimum wage – farm workers] of this regulation.
2 Section 15 is repealed.
3 Section 18 is amended
(a) by repealing subsection (1) (c) to (f), (h), (k), (m) and (n) and substituting the following:
(c) | beans | $0.699 a kg; |
(d) | blueberries | $1.184 a kg; |
(e) | Brussels sprouts | $0.487 a kg; |
(f) | cherries | $0.672 a kg; |
(h) | mushrooms | $0.703 a kg; |
(k) | peas | $0.873 a kg; |
(m) | raspberries | $1.065 a kg; |
(n) | strawberries | $1.027 a kg. , and |
(b) by adding the following subsection:
(1.2) For the purposes of the adjustment under section 16.2 (3) [annual adjustment of minimum wage] of the Act of a minimum wage described in subsection (1) or (1.1) of this section,
(a) the minimum wage is adjusted every year on December 31, beginning on December 31, 2024, and
(b) in the case of a minimum wage that is described by reference to the gross weight or number of the crop picked, the adjusted minimum wage is rounded to the nearest multiple of $0.001 or, if the adjusted minimum wage is equidistant from 2 consecutive multiples, to the higher multiple.
