B.C. Reg. 128/2024, deposited June 10, 2024, under the SHORTTERM RENTAL ACCOMMODATIONS ACT [section 38]. Order in Council 309/2024, approved and ordered June 10, 2024.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) the Short‑Term Rental Accommodations Regulation, B.C. Reg. 268/2023, is amended as set out in the attached Schedule 1, and

(b) effective November 1, 2024, the Short‑Term Rental Accommodations Regulation, B.C. Reg. 268/2023, is amended as set out in the attached Schedule 2.

Schedule 1

1 Section 3.1 of the Short-Term Rental Accommodations Regulation, B.C. Reg. 268/2023, is amended

(a) in subsection (2) (a) (ii) (A) and (b) (ii) (A) by striking out "each owner" and substituting "one or more owners",

(b) in subsection (2) (a) (ii) (D) and (b) (ii) (D) by striking out "section 559 [definitions for Part XVII] of the Vancouver Charter" and substituting "section 559 [definitions for Part XXVII] of the Vancouver Charter", and

(c) in subsection (2) (b) (ii) by striking out "are not able to be used as a" and substituting "are, on the occupancy date, not able to be used and continue to not be able to be used, as a".

2 Section 14 is amended

(a) in subsection (2) by striking out "must be disclosed to the minister" and substituting "must, subject to subsection (2.1), be disclosed to the minister", and

(b) by adding the following subsection:

(2.1) The minister may extend the 15-day period referred to in subsection (2) if the electronic portal referred to in subsection (3) (b) is not available.

3 Section 30 (2) is amended by striking out "section 15 (b) (ii) (A) or (c) (i)" and substituting "section 15 (b) (ii) (A) or (c)".

4 Schedule 1 is amended in paragraph (c) by striking out "listed" and substituting "set out".

Schedule 2

1 Section 10 (2) of the Short-Term Rental Accommodations Regulation, B.C. Reg. 268/2023, is repealed.

2 Schedule 1 is amended

(a) in paragraph (a) by striking out the following:

Bowen Island Municipality

The Corporation of the District of Kent

Village of Pemberton ,

(b) in paragraph (b) by striking out the following:

District of Tofino

Town of Osoyoos , and

(c) by repealing paragraphs (g) and (i) and substituting the following:

(g) the trust area, as defined in section 1 of the Islands Trust Act, except for the following:

(i) Bowen Island Municipality;

(ii) Gabriola Island;

(i) electoral areas, except the following:

(i) Electoral Area A, Electoral Area C, Electoral Area E, Electoral Area F, Electoral Area G and Electoral Area H of the Cowichan Valley Regional District;

(ii) Electoral Area B and Electoral Area C of the Strathcona Regional District;

(iii) Electoral Area D, Electoral Area F and Electoral Area I of the Regional District of Okanagan-Similkameen;

(iv) that part of Electoral Area A of the Metro Vancouver Regional District that is the University of British Columbia and the University Endowment Land, as defined in section 1 of the University Endowment Land Act.
