On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Oil and Gas Waste Regulation, B.C. Reg. 254/2005, is amended as set out in the attached Schedule.

Schedule

1 Section 1 of the Oil and Gas Waste Regulation, B.C. Reg. 254/2005, is amended by repealing the definition of "operator" and substituting the following:

"operator" means, in relation to a facility or piece of equipment, a person who, under a permit issued under section 25 of the Energy Resource Activities Act, is permitted to carry out an oil and gas or storage activity, as defined in that Act, that is or that involves the operation of the facility or piece of equipment; .
