On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Tree Seeds and Services Regulation, B.C. Reg. 138/2019, is amended as set out in the attached Schedule.

Schedule

1 Section 3 of the Tree Seeds and Services Regulation, B.C. Reg. 138/2019, is amended

(a) in subsection (1) (b) by striking out "climactic" and substituting "climatic", and

(b) in subsection (2) by striking out "$0.03" and substituting "$0.04".

2 Section 5 is amended

(a) by repealing subsection (1) and substituting the following:

(1) The fee to process seeds for registration and storage is the sum of all of the following fees that are applicable:

(a) if extraction of the seeds from cones is not required, $100;

(b) if extraction of the seeds from cones is required, the fee determined under subsection (2);

(c) if atypical effort is required to process the seeds or the person to whom the service is provided requests that the seeds be processed in a special manner, the fee determined under subsection (3). ,

(b) in subsection (2) (a) by striking out "$150" and substituting "$200",

(c) in subsection (2) (b) (ii) (A) by striking out "$200" and substituting "$267",

(d) in subsection (2) (b) (ii) (B) by striking out "$300" and substituting "$401",

(e) by repealing subsection (2) (b) (iii),

(f) in subsection (3) by striking out "subsection (2) (b) (iii)" and substituting "subsection (1) (c)", and

(g) in subsections (3) (a) and (4) by striking out "$60" and substituting "$80".

3 Section 6 (1) is amended by striking out "$24" and substituting "$32".

4 Section 7 is amended

(a) in subsection (1) (a) by striking out "$16" and substituting "$21", and

(b) by repealing subsection (2) and substituting the following:

(2) The fee for pelleting is the sum of a basic fee of $83 and the fee per gram of seeds that the government is charged to have the seeds pelleted.

5 Section 8 is amended

(a) in subsections (1) and (3) (b) by striking out "$12" and substituting "$16", and

(b) in subsection (3) (a) by striking out "$6" and substituting "$8".

6 Schedule 1 is amended by repealing Tables 1 and 2 and substituting the following:
