On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Agricultural Land Reserve Use Regulation, B.C. Reg. 30/2019, is amended as set out in the attached Schedule.

Schedule

1 The Agricultural Land Reserve Use Regulation, B.C. Reg. 30/2019, is amended by adding the following section:

Temporary exception for wine made from grapes

13.01 (1) In this section:

"primary farm product rule" means a requirement respecting the proportion of primary farm product used to make an alcohol product imposed under

(a) section 13 (2) of this regulation, or

(b) section 2 (2) (b) of the Agricultural Land Reserve Use, Subdivision and Procedure Regulation as it read on June 14, 2015;

"temporary exception period" means the period that

(a) begins on the date on which this section comes into force, and

(b) ends on March 31, 2025.

(2) Despite section 13, primary farm product rules do not apply with respect to either of the following:

(a) the processing by a winery of wine made from grapes or grape products acquired by the winery during the temporary exception period, if processing begins during that period;

(b) the continued processing, and the storage and sale, of wine to which paragraph (a) applies.
