On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective August 1, 2024,

(a) the Fire Safety Act, S.B.C. 2016, c. 19, except section 56 (b), is brought into force, and

(b) the attached Fire Safety Regulation is made.

FIRE SAFETY REGULATION

Definition

1 In this regulation, "Act" means the Fire Safety Act.

Maximum costs recoverable for securing evacuated premises

2 For the purposes of section 15 of the Act, the prescribed maximum amount of costs recoverable from an owner by a local authority or the fire commissioner for securing evacuated premises is $100 000.

Maximum administrative penalty amounts

3 The maximum penalty that may be imposed for a contravention referred to in section 33 (1) (b) of the Act is as follows:

(a) in the case of an individual, $25 000;

(b) in the case of a corporation, $50 000.

Administrative penalty for continuing contraventions

4 If the fire commissioner imposes an administrative penalty under section 33 (1) [imposing administrative penalty] of the Act, and the failure or contravention referred to in that section continues for more than one day, separate administrative penalties, each not exceeding the maximum administrative penalty in section 33 (2) of the Act or section 3 of this regulation, as applicable, may be imposed by the fire commissioner for each day the failure or contravention continues.
