DESIGNATED USE HIGHWAYS (UBC NEIGHBOURHOODS) REGULATION
Definitions
1 In this regulation:
"accessible parking permit" has the same meaning as "permit" in section 38.01 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58;
"Act" means the Motor Vehicle Act;
"ambulance" has the same meaning as in section 1 of the Emergency Health Services Act;
"designated use highway" has the same meaning as in section 119 of the Act;
"disabled zone" has the same meaning as in section 38.01 of the Motor Vehicle Act Regulations;
"park" has the same meaning as in section 119 of the Act;
"parking year" means a year beginning on May 1 and ending on April 30;
"stop" and "stand" have the same meaning as in section 119 of the Act;
"traffic control device" has the same meaning as in section 119 of the Act;
"university neighbourhood" means a neighbourhood that is shaded in orange and identified by name on the map attached to this regulation;
"university neighbourhood parking permit" has the meaning given to it by section 4 (1) of this regulation;
"university neighbourhood street" means a highway or part of a highway that
(a) is shaded in a colour on the map attached to this regulation, and
(b) a traffic control device indicates is a designated use highway;
"university neighbourhoods association" means the University Neighbourhoods Association incorporated under the Societies Act.
University neighbourhood traffic control persons
2 Persons employed or retained by or on behalf of the University of British Columbia as traffic control persons are designated as traffic control persons for the university neighbourhoods streets.
Parking reserved on university neighbourhood streets
3 (1) This section applies in relation to stopping, standing and parking a vehicle on a university neighbourhood street.
(2) The university neighbourhood streets are reserved at the following locations for the exclusive use of the vehicles specified for the location:
(a) at a location where a traffic control device indicates that parking is restricted to maintenance or authorized vehicles,
(i) a vehicle displaying a valid university neighbourhood parking permit, or
(ii) a service or maintenance vehicle;
(b) at a disabled zone, a vehicle displaying both an accessibility parking permit in accordance with section 38.03 of the Motor Vehicle Act Regulations and a valid university neighbourhood parking permit;
(c) at a location where a traffic control device indicates that parking is restricted to car-share vehicles, a car-share vehicle;
(d) at a location where a traffic control device indicates that parking is restricted to specified car-share vehicles, a car-share vehicle specified on the traffic control device.
(3) A person must not stop, stand or park a vehicle
(a) at a location that is reserved under subsection (2) other than a vehicle for which the location is reserved, or
(b) at another location on the university neighbourhood streets contrary to the instructions of a traffic control device.
(4) This section does not apply in relation to an ambulance.
University neighbourhood parking permits
4 (1) The following permits issued by the university neighbourhoods association are university neighbourhood parking permits:
(a) a parking permit issued before the date this regulation comes into force;
(b) a parking permit issued on or after that date in accordance with section 5.
(2) Subject to subsection (3), a university neighbourhood parking permit is valid
(a) in the university neighbourhood specified on the permit, and
(b) for the period or on the date specified on the permit.
(3) A university neighbourhood parking permit is not valid if the length of the vehicle on which the permit is displayed is greater than 21 feet.
Administration of university neighbourhood parking permits
5 (1) For the purposes of this regulation, the university neighbourhoods association may issue to a person who resides in a residential unit with an address in a university neighbourhood a parking permit to which the residential unit is entitled under subsection (2).
(2) A residential unit with an address in a university neighbourhood is entitled, for each parking year, to the following parking permits:
(a) one resident parking permit for each vehicle, other than a trailer, that is owned, leased or regularly operated by a person who resides at the residential unit, up to a maximum of 2 vehicles;
(b) one visitor parking permit;
(c) 15 single-day parking permits.
(3) A parking permit referred to in subsection (2) (a) or (b) that is issued under this section must specify
(a) the university neighbourhood in which the permit is valid, and
(b) the parking year for which the permit is valid.
(4) A parking permit referred to in subsection (2) (c) that is issued under this section must specify the university neighbourhood in which the permit is valid.
