Definitions

1 In this regulation:

"Act" means the School Act;

"class" means,

(a) with respect to students in kindergarten and grades 1 to 7, a group of students scheduled to spend all or the majority of their time together in a classroom during the school year for the purposes of instruction in an educational program, and

(b) with respect to students in grades 8 to 12, a group of students regularly scheduled to be together in a classroom for the purposes of instruction in an educational program;

"student with special needs" means a student who

(a) has a learning disability or has a disability of an intellectual, physical, sensory, emotional or behavioural nature, or

(b) has exceptional gifts or talents.

Kindergarten

2 (1) The average class size, in the aggregate, for kindergarten classes in a school district is determined by the formula:

(2) For the purposes of counting kindergarten classes under subsection (1), if a class contains kindergarten students and students in another grade, the class must not be counted as one class but as a portion of a class determined by the formula, calculated to one decimal place:

Primary grades

3 (1) The average class size, in the aggregate, for grades 1 to 3 in a school district is determined by the formula:

(2) For the purposes of counting grades 1 to 3 classes under subsection (1), if a class contains students in grades 1 to 3 and students in kindergarten or another grade, the class must not be counted as one class but as a portion of a class determined by the formula, calculated to one decimal place:

Intermediate and secondary grades

4 (1) The average class size, in the aggregate, for grades 4 to 12 in a school district is determined by the formula:

(a)  the total number of students in grades 4 to 7 in the school district, as of September 30;
(b)  the total number of students in grades 8 to 12 assigned to each class offered in the
school year in the school district, as of September 30;
classes  =  the total of the following:
(a)   the total number of grades 4 to 7 classes in the school district, as of September 30;
(b)  the total number of grades 8 to 12 classes offered in the school year in the school
district, as of September 30.

(2) For the purposes of counting grades 4 to 12 classes under subsection (1), if a class contains students in grades 4 to 12 and students in another grade, the class must not be counted as one class but as a portion of a class determined by the formula, calculated to one decimal place:

Exclusions

5 In determining class sizes under sections 2 to 4, a board must exclude the following:

(a) a student in an adult or continuing education program;

(b) a student in a distance education school;

(c) a student in a distance education school electronic learning program;

(d) a student in a district electronic learning program;

(e) a student in a Provincial resource program;

(f) a student in an alternate program;

(g) a student in a work study or work experience program;

(h) a class operated exclusively for students with special needs.

Reports

6 (1) On or before October 30 of each year, a board must submit to the minister a report that

(a) declares that

(i) the board has determined the average class size, in the aggregate, for kindergarten, grades 1 to 3 and grades 4 to 12 in accordance with this regulation,

(ii) the average class size referred to in subparagraph (i) does not exceed the averages specified in section 76.1 of the Act, and

(iii) the size of any kindergarten or grades 1 to 3 class in any school in its school district does not exceed the limits specified in section 76.1 of the Act, and

(b) is signed by the chair of the board.

(2) On or before October 30 of each year, a board must prepare a report that contains the following information:

(a) the average class size, in the aggregate, as determined under sections 2 to 4;

(b) the number of students in the school district, as of September 30, in each

(i) kindergarten class, and

(ii) grades 1 to 3 class.

(3) On or before October 30 of each year, a board must

(a) make publicly available, during business hours at the office of each school in the school district, copies of the report referred to in subsection (2), and

(b) submit copies of the report referred to in subsection (2) to the chair of each parents' advisory council in the school district.
