Debtor Assistance Act

DEBTOR ASSISTANCE FEE REGULATION

Fee on trust money

1 If the director receives money in trust under section 7 of the Debtor Assistance Act, the debtor from whom the money is received must pay a fee of $10 or 15% of the money received in trust, whichever is greater.

Exception

2 Section 1 does not apply if

(a) the money was received in trust in relation to an arrangement or consolidation order under the Bankruptcy and Insolvency Act (Canada), or

(b) the director is of the opinion that the imposition of the fee would pose an undue hardship to the debtor.
