Homeowner Protection Act

Form of evidence prescribed

1  For the purposes of section 30 (1) of the Act, the form of evidence to be provided by an applicant for a building permit to a municipality or regional district is as follows:

(a) if the application is for a new home to be built by an owner builder, a document certified by the registrar that the new home may be built by the owner builder named in the document;

(b) if the application is for a new home to be built by a residential builder, a document

(i) certified by the registrar that the residential builder is licensed under the Act to build the new home, and

(ii) certified by a warranty provider that the new home is covered by home warranty insurance;

(c) if the application is for a new home that is exempt under section 2 of the Homeowner Protection Act Regulation, B.C. Reg. 29/99, a declaration by the builder of the new home or the owner of the property on which the new home is to be built that the new home is exempt from the requirement to be covered by home warranty insurance.
