Community Charter

Conflicts of Interest Exceptions
(Sun Peaks Mountain Resort Municipality) Regulation

Definitions

1   In this regulation:

"Act" means the Community Charter;

"corporation" means the Sun Peaks Resort Corporation;

"councillor" means a councillor appointed to the council of Sun Peaks Mountain Resort Municipality under section 25 (1) (b) (i) [appointment by minister] of the Local Government Act.

Nature of pecuniary interest

2   A pecuniary interest in the nature of remuneration, expenses, benefits, dividends, profits or other amounts payable to a councillor as a result of the councillor being a director, senior officer or shareholder or an employee of the corporation, or of a subsidiary or parent of the corporation, is prescribed for the purposes of section 104 (1) (e) [exceptions from conflict provisions] of the Act.

Exception to restriction on use of insider information

3   Section 108 [restrictions on use of insider information] of the Act does not apply to a councillor in respect of a pecuniary interest of the nature prescribed under section 2 during the term of the councillor's appointment.
