I, Nathan Cullen, Minister of Water, Land and Resource Stewardship, order that, effective March 1, 2024, the Public Access Prohibition Regulation, B.C. Reg. 187/2003, is amended as set out in the attached Appendix.

Appendix
1 Section 1 of the Public Access Prohibition Regulation, B.C. Reg. 187/2003, is repealed and the following substituted:
Definitions
1 In this regulation:
"motor vehicle" has the same meaning as in the Motor Vehicle Prohibition Regulation;
"M.U." or "management unit" means an area designated as a management unit by the Management Unit Regulation.
2 Sections 2, 3, 4, 6 and 7 are repealed.
3 Section 10 is repealed and the following substituted:
Baynes Lake
10 (1) In this section:
"map" means the attached map titled Baynes Lake Public Access Prohibited Area and dated March 26, 2021;
"prohibited area" means that portion of Management Unit 4-22 outlined in orange on the map, other than the portion of that Management Unit that is
(a) the unsurveyed portion of Parcel 1, District Lot 132, Kootenay District, Explanatory Plan DD5116, containing approximately 0.433 hectares, and
(b) tenured under the Land Act to Castle Rock Enterprises Inc., file 44003970.
(2) A person commits an offence if the person uses or operates a motor vehicle in the prohibited area other than on Waldo Cove Road.
(3) Subject to subsection (4), a person commits an offence if, during the period April 15 to July 15,
(a) the person accesses the prohibited area by air, or
(b) the person accesses the prohibited area by land or water for any purpose other than using the boat launch shown highlighted in pink on the map.
(4) The prohibitions in subsection (3) (a) and (b) do not apply in the portion of the prohibited area that is
(a) Beach Area #1, District Lot 132, Explanatory Plan DD.R20629, or
(b) Beach Area #2, District Lot 132, Explanatory Plan DD.R20628.
(5) A person commits an offence if, during the period April 1 to July 31, the person accesses the prohibited area with a dog that is not under the direct control of a person and restrained by a leash not longer than 2 metres.
