On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Municipal Wastewater Regulation, B.C. Reg. 87/2012, is amended as set out in the attached Schedule.

Schedule

1 Section 1 of the Municipal Wastewater Regulation, B.C. Reg. 87/2012, is amended

(a) in the definition of "advanced treatment" by striking out "BOD₅" and substituting "CBOD₅",

(b) by repealing the definition of "BOD₅",

(c) by adding the following definitions:

"CBOD₅" means the carbonaceous 5‑day biochemical oxygen demand;

"CFU" means a colony forming unit; , and

(d) in the definition of "primary treatment" and in paragraphs (a) and (b) of the definition of "secondary treatment" by striking out "BOD₅" and substituting "CBOD₅".

2 Section 13 (b) is amended by striking out "signed and stamped" and substituting "signed and sealed".

3 Section 29 (b) (ii) is amended by striking out "in respect of capital equipment" and substituting "in respect of machinery and equipment".

4 Section 31 is amended

(a) in subsection (1) (b) by striking out "an expert consultant selected from the roster established under subsection (2)" and substituting "an expert consultant whose qualifications are acceptable to the director",

(b) in subsection (1) (c) by striking out "the consultant" and substituting "the expert consultant",

(c) by repealing subsection (2), and

(d) in subsection (3) by striking out "a consultant" and substituting "an expert consultant".

5 Section 46 (a) (ii) is amended by striking out "certified as correct and sealed by a qualified professional" and substituting "certified as correct and signed and sealed by a qualified professional".

6 Section 56 (2) is amended by striking out "may be used in place of BOD₅ if BOD₅ is examined" and substituting "may be used in place of CBOD₅ if CBOD₅ is examined".

7 Section 58 (2) (a) is amended by striking out "BOD₅" and substituting "CBOD₅".

8 Section 75 is amended in Table 3 under the heading "Requirement" by striking out "BOD₅" and substituting "CBOD₅".

9 Section 86 is amended in the leftmost columns of Tables 6, 7 and 8

(a) by striking out "BOD₅" and substituting "CBOD₅", and

(b) by striking out "NO₃" and substituting "nitrate".

10 Section 89 (2) is amended in paragraph (c) of the definition of "mean low water" by striking out "7‑day flow" and substituting "7‑day low flow".

11 Section 94 is amended in the leftmost columns of Tables 9, 10 and 11 by striking out "BOD₅" wherever it appears and substituting "CBOD₅".

12 Section 103 (2) is amended by striking out "BOD₅" and substituting "CBOD₅".

13 Section 103 is amended in the leftmost column of Table 12

(a) by striking out "BOD₅" and substituting "CBOD₅",

(b) by striking out "NH₄‑N, PO₄‑P, total phosphorus frequency and type (freshwater)" and substituting "ammonia, ortho‑phosphate, total phosphorus frequency and type (freshwater)", and

(c) by striking out "NH₄‑N, PO₄‑P, total phosphorus frequency and type (marine)" and substituting "ammonia frequency and type (freshwater)".

14 Section 108 is amended in Table 13

(a) under the column heading "Parameters" by striking out "BOD₅" and substituting "CBOD₅", and

(b) under the column heading "Indirect potable reuse" by striking out "BOD₅" and substituting "CBOD₅" and by striking out "median < 1 CFU or < 2.2 MPN" and substituting "median < 1 CFU or < 2.2 MPN; maximum 14 CFU".

15 Section 118 is amended in Table 14 under the column heading "Parameters" by striking out "BOD₅" and substituting "CBOD₅".
