On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) the Commercial Transport Regulations, B.C. Reg. 30/78, are amended as set out in the attached Schedule 1, and

(b) the Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended as set out in the attached Schedule 2.

Schedule 1

1 Section 1.01 of the Commercial Transport Regulations, B.C. Reg. 30/78, is amended

(a) in the definition of "logging truck" by striking out "truck or truck and trailer combination" and substituting "truck, truck and trailer combination or truck tractor and trailer combination",

(b) in paragraph (e) of the definition of "permanently mounted equipment" by striking out "straight",

(c) by repealing the definition of "super single tire",

(d) in the definition of "tridem drive axle" by striking out "2.5 m" and substituting "2.45 m" and by striking out "super single tires" and substituting "wide base single tires",

(e) in the definition of "turn centre" by striking out "axle group" in both places and substituting "axle unit", and

(f) by adding the following definition:

"wide base single tire" means a tire that has a tire width of 445 mm or larger and a bead diameter of 49.5 cm or larger and that meets the requirements of the Motor Vehicle Tire Safety Regulations (Canada); .

2 Section 7.02 (16) is amended by striking out ", including Appendices B, C, D, E, F, G, H and I" and substituting "and Appendices B, C, D, E, F, G, H and I".

3 Section 7.07 (1) is amended

(a) by striking out "super single tires" wherever it appears and substituting "wide base single tires", and

(b) in paragraph (d) by striking out "2.5 m" and substituting "2.45 m".

4 Section 7.10 (b) is amended by striking out "tridem axle unit" and substituting "a tridem axle".

5 Section 7.12 (b) is amended by striking out "axle group" and substituting "axle unit".

6 Section 7.16 (1) is amended

(a) in paragraph (c) by striking out "tridem or tandem axle group" and substituting "tridem axle or tandem axle", and

(b) in paragraph (e) by striking out "tridem axle group" and substituting "tridem axle".

7 Section 7.23 (3) is amended

(a) in paragraph (b) by striking out "straight", and

(b) in paragraphs (d), (f) and (h) by striking out "group".

8 Section 7.25 is repealed and the following substituted:

Wide base single tires

7.25 A person must not, without a permit, use wide base single tires, unless

(a) the wide base single tires

(i) are used on a single, tandem or tridem axle,

(ii) do not support more than 4 550 kg each,

(iii) do not support a tire loading of more than 100 kg per 1.0 cm of tire width, unless they are used on the single steering axle, and

(iv) are all, on an axle unit, of equal tire width, and

(b) subject to section 7.07 (1) (c), the axles on which the wide base single tires are installed

(i) do not have dual wheels or single tires installed on them,

(ii) do not support more than 9 100 kg each, and

(iii) have the axle track width in column 2 that corresponds to the axle unit opposite it in column 1 in the table below.

9 Section 7.26 is amended

(a) in subsection (1) by striking out "Subject to subsection (1.1) and (2)" and by substituting "Subject to subsections (1.1), (1.2), and (2)" and by striking out ", including those referred to in the Appendices" and substituting "and the Appendices",

(b) by adding the following subsection:

(1.2) Despite the limitations set out in the Appendices and subject to the manufacturer’s rated capacity for the tire and axle, the single steering axle of a logging truck other than a logging truck described in Appendix D or G may have a gross weight of up to 9 100 kg. , and

(c) by repealing subsection (2) and substituting the following:

(2) Despite the limitations set out in the Appendices and subject to the manufacturer’s rated capacity for the tire and axle, a logging truck may have a tire loading of 110 kg per 1.0 cm of tire width.

10 Section 7.31 (2) is amended by striking out "a tridem pole trailer" and substituting "a tridem pole trailer or a semi-trailer equipped with a tridem axle".

11 Appendices A, B, C, D, E, F, G, H and I to Division 7 are repealed and the attached Appendices A, B, C, D, E, F, G, H and I are added after Division 12.

Schedule 2

1 Section 6.14 (6) of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended by adding "and the appendices to" after "Division 7 of".

2 Section 7.001 is amended by repealing the definition of "super single tire" and by adding the following definition:

"wide base single tire" means a wide base single tire as defined in the Commercial Transport Regulations.

3 Sections 7.1632 (1) (c), 7.1633 (1) (c) and 7.1634 (1) (c) are amended by striking out "super single tires" and substituting "wide base single tires".

4 Section 19.02 (1) is amended by striking out "Division 7 of B.C. Reg. 30/78, made under the Commercial Transport Act" and substituting "Division 7 of and the appendices to the Commercial Transport Regulations".

5 Section 19.04 is amended by striking out "B.C. Reg. 30/78, made under the Commercial Transport Act" and substituting "the Commercial Transport Regulations".
