On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(a) the Agricultural Land Reserve Use Regulation, B.C. Reg. 30/2019, is amended as set out in Appendix 1, and

(b) the Farm Income Plans Regulation, B.C. Reg. 123/2004, is amended as set out in Appendix 2.

Appendix 1

1 The Agricultural Land Reserve Use Regulation, B.C. Reg. 30/2019, is amended by adding the following section:

Farm products – temporary exception for specified fruits

11.1 (1) In this section:

"farm product rule" means a requirement imposed under section 11 (2) respecting the proportion of farm product stored, packaged, prepared or processed;

"specified facility" means a facility, in existence on the first day of the temporary exception period, for storing, packing, preparing or processing fruit all or most of which is specified fruit;

"specified fruit" means any of the following:

(a) apples;

(b) apricots;

(c) cherries;

(d) nectarines;

(e) peaches;

(f) pears;

(g) prune plums;

(h) table grapes;

"temporary exception period" means the period that

(a) begins on the date on which this section comes into force, and

(b) ends on March 31, 2025.

(2) Despite section 11 (2), the farm product rule does not apply with respect to the storing, packing, preparing or processing of specified fruit at a specified facility during the temporary exception period.

Appendix 2

1 Section 3.1 (1) of the Farm Income Plans Regulation, B.C. Reg. 123/2004, is amended by adding the following paragraph:

(c) a document entitled British Columbia AgriStability Enhancement Program Guidelines – 2024 Taxation Year.
